A federal judge on Wednesday ruled that a Chicago man may face a misdemeanor fine and ordered the city to pay a $5.3 million criminal fine for failing to file a complaint with the Food and Drug Administration and the Department of Health and Human Services.
“I would like to comment on the case and I’ll make it clear to all that I believe it is a felony to sell or use any drug,” said David Mazzarella, a former state representative from Chicago.
The case was brought by GlaxoSmithKline, the manufacturer of Viagra. Mazzarella is charged with selling or using any drug to fix erectile dysfunction. He is facing a $2.1 million fine.
Mazzarella and other defendants are accused of failing to file an application for federal approval before June 15, 2014, according to a criminal complaint.
Mazzarella is cooperating with the prosecution. According to a criminal complaint, he pleaded guilty to one felony count of selling or using a narcotic drug in a scheme to fix erectile dysfunction.
